Introduction

1. The Pont3 Volunteer Points Incentive Program is operated by Pont3 Pty Ltd.
2. Participation in the Pont3 Volunteer Points Incentive Program is optional, and while sitting alongside, is separate from, any volunteering role.
3. Participation in Pont3 Volunteer Points Incentive Program is governed by these terms.

Definitions

Event Day means the date advertised for a Pont3 event to occur.

Event Week means the period of seven (7) days leading up to the Event Day.

Fundraising Group Volunteer means a Volunteer participating as part of a registered fundraising group that receives a charitable donation.

Incentive Points means the units of reward accrued by a Volunteer in a manner proportional to the number of hours spent volunteering at Pont3 events. 

Pont3 Volunteer Points Incentive Program means the voluntary, non‑cash rewards program operated by Pont3 under these terms, under which eligible volunteers may earn, hold and redeem points for nominated prizes based on volunteer hours worked at Pont3 events.

Prizes means the goods/services, as determined and listed by Pont3, for which Incentive Points can be exchanged.

Volunteer means a person who contributes to Pont3 events with no expectation of payment with respect to their participation.

Interpretation

In this agreement unless the context otherwise requires:

1. a reference to an Act or other legislation, include regulations or any subordinate legislation, and includes all amendments and substituted legislation from time to time;
2. the singular includes the plural and vice versa;
3. a reference to an individual or person includes a corporation, partnership, joint venture, association, authority, trust, state or government and vice versa;
4. a reference to any gender includes all genders;
5. a reference to a clause or schedule is to a clause or schedule of this agreement;
6. a reference to an item or paragraph is to an item or paragraph of the relevant schedule of this agreement;
7. the schedules and attachments form part of this agreement;
8. a reference to any agreement or document is to that agreement or document (and, where applicable, any of its provisions), as amended, novated, supplemented or replaced from time to time;
9. a reference to any party to this agreement, or any other document or arrangement, includes that party’s executors, administrators, substitutes, successors and permitted assigns;
10. where an expression, word or phrase is defined, another part of speech or grammatical form of that expression, word or phrase has a corresponding meaning;
11. where an expression is defined anywhere in this agreement it has the same meaning throughout;
12. a reference to “dollars” or “$” is to an amount in Australian currency;
13. any phrase introduced by the terms “including” or “in particular”, or any similar expression, is to be construed as illustrative and not limiting of any preceding words;
14. a reference to any Australian Commonwealth or State legal term for any action, remedy, method of judicial proceeding, legal document, legal status, court, official or any legal concept, state of affairs or thing will in respect of any jurisdiction other than Australia be deemed to include that which most nearly approximates in that jurisdiction to the relevant Australian legal term and a reference to any Commonwealth or State statute will be construed so as to include equivalent or analogous laws of any other jurisdiction;
15. a reference to a document ‘in the agreed form’ is a reference to the form of that document signed or initialled for identification purposes by or on behalf of the parties to this agreement;
16. a reference to ‘writing’, or any similar expression, is a reference to any mode of representing or reproducing words in a visible, non transitory form and includes email but does not include any other mode of representing or reproducing words in electronic form;
17. a reference in this agreement to a business day means a day other than a Saturday or Sunday on which banks are open for business generally in New South Wales; and
18. if the day on which any act, matter or thing is to be done under this agreement is not a business day, the act, matter or thing must be done on the next business day.

Eligibility

1. Registered individual or group Volunteers for Pont3 events are eligible to receive Incentive Points for shifts worked during Event Week.
2. Participation in the Pont3 Volunteer Points Incentive Program does not create any employment, contractor or agency relationship with Pont3. Volunteers shall not receive wages or other employment entitlements in respect of their participation.
3. The purpose of volunteering remains as contributing to Pont3 events. Incentive points are an incidental and discretionary initiative which Pont3 may vary or cancel at any time.

Volunteers are under no obligation to participate in the Pont3 Volunteer Points Incentive Program. Non-participation shall not affect any person’s ability to volunteer, subject to usual rostering and conduct requirements.

Fundraising Group Volunteer Eligibility

4. Fundraising Group Volunteers are only permitted to undertake the volunteer shift allocated to their group for the relevant event. These Volunteers will not be eligible to earn Incentive Points for that event. 
5. Fundraising Group Volunteers may be eligible to earn incentive points for volunteer hours completed at other Pont3 events where they are not participating as part of a fundraising group and where the relevant incentive program terms and conditions are met.
6. Fundraising Group Any change in participation status may affect volunteer eligibility, shift availability, and incentive point accrual.

Incentive Points Accrual

7. Incentive Points have no cash value, cannot be exchanged for cash or credit, and are not property or a financial product.
8. Registered Volunteers are eligible to receive ten (10) Incentive Points per hour worked. A full hour must be worked to receive Incentive Points. Pro rata points will not be awarded for working partial shifts. Pont3’s records of hours worked, including sign-in/out times, are conclusive, absent manifest error.
9. The Pont3 Volunteer Incentives Program commenced in July 2025, and Incentive Points will not be applied retrospectively.

Points Use and Expiry

10. Incentive Points will expire three (3) years from the date they are earned. Pont3 retains the right to cancel Incentive Points where there has been fraud, misuse, or a material breach of the Volunteer Code of Conduct or these terms.
11. Incentive Points are non-transferable and may only be redeemed by the volunteer. Incentive Points cannot be combined with another Volunteer’s Incentive Points, unless Pont3 expressly permits otherwise.
12. Prizes, their required Incentive Points balance, and any key conditions (e.g. size ranges, colour, validity period etc.) will be listed on the volunteer web page. Prizes may change from time to time. Any statutory warranties for third-party products are provided by the manufacturer, not Pont3.

• While every effort is made to accurately advertise available stock and Prizes, if a Prize cannot be fulfilled after redemption, the corresponding Incentive Points will be credited back to the Volunteer.

14. Once Incentive Points are redeemed for a Prize, they will be deducted from the Volunteer’s total Incentive Points balance. To redeem Incentive Points for a Prize, Volunteers must email volunteers@pont3.com advising of the Prize they wish to redeem. Prizes will be posted to Volunteers or delivered electronically, if applicable.
15. Prizes are not for resale, and may not be transferred once issued, except where required by law or otherwise in agreement with Pont3.
16. After every event, Pont3 will update the points ladder on the Pont3 volunteer page with updated points totals. Pont3 will maintain a record of each Volunteer’s points balance and will provide an updated balance on request.
17. Pont3 may, acting reasonably, change the earn rate, expiry rules, or other aspects of the Pont3 Volunteer Points Incentive Program on notice. Notice may include updating the volunteer web page, or where practical emailing currently registered Volunteers.

Privacy and Communications

18. In running the program, Pont3 shall collect personal information, including the Volunteer’s name, email, contact address for postage, and points history.
19. The Pont3 Volunteer Points Incentive Program shall be governed by Pont3’s existing Privacy Policy, which is available on the Pont3 website.
20. In participating in the Pont3 Volunteer Points Incentive Program, Volunteers consent to Pont3 sending program-related communications (including points balance, Prize offers, changes to Terms and Conditions) via email.

Governing Law

21. These terms shall be governed by the laws of New South Wales.

Severability

22. Any provision in this agreement which is invalid or unenforceable in any jurisdiction:
    1. is to be read down for the purposes of that jurisdiction if possible; or
    2. if it cannot be read down, is to be severed to the extent of the invalidity or unenforceability for the purposes of that jurisdiction, so as to be valid and enforceable in that jurisdiction.

Notices

23. A notice, consent, approval or other communication (each a Notice) under this agreement must be in writing, signed by or on behalf of the person giving it, addressed to the person to whom it is to be given and:
    1. delivered to that person’s postal address;
    2. sent by pre-paid mail to that person’s postal address; or
    3. sent by email to that person’s email address.
24. A Notice given to a person in accordance with this clause is treated as having been given and received:
    1. if delivered to a person’s address, on the day of delivery if a business day, otherwise on the next business day;
    2. if sent by pre-paid mail, on the third business day after posting; or
    3. if sent by email and the sender does not receive a message from its internet service provider or the recipient’s mail server indicating that it has not been successfully transmitted, on the day of sending if a business day, otherwise on the next business day.

Variation or Termination

25. Pont3 reserves the right to alter, amend or terminate the program at any time without Notice.

Acceptance of Terms

Continued participation in the Pont3 Volunteer Points Incentive Program shall be taken as acceptance of these terms.
